David B. Wilkins, faculty director of the HLS Center on the Legal Profession, was recently quoted in Forbes, on the legal tech startup EvenUp’s use of AI to help personal injury attorneys draft demand letters and figure out how much to ask insurance companies for settlements. “The platform works by having attorneys upload their client’s medical records into EvenUp’s system, which draws on more than 250,000 verdicts and settlements to produce a demand package with an appropriate settlement offer,” the article states. Further, “Harvard Law School Professor David Wilkins sees promise in the ability of generative AI to make legal processes more efficient, but he cautions defendants may be less intimidated by demand letters that they suspect are written with AI if they’re not convinced that the plaintiff’s lawyers have the experience or expertise to litigate the case aggressively.” He told Forbes:
“The insurance companies undoubtedly are going to, if they haven’t already, invest in similar kinds of technology … So now we’ve got an arms race, and the insurance companies are much more likely to have technology that’s customized and that is updated because they know their risk profiles and portfolio of cases.”
